Terms of Use

1Definitions

2Purpose

These Terms of Use ("Terms") govern access to and use of the App. They apply to every User, without exception or reservation.

3Acceptance

Creating an Account and using the App constitute full and unconditional acceptance of these Terms. If you do not accept these Terms, you must not use the App.

4Access, age, and account

Access to the App is restricted to people aged 16 and over. Creating an Account requires a valid email address or a Google / Apple account. You are responsible for keeping your credentials confidential and for any activity carried out from your Account.

The readiness indicators, tap test, and "daily form" scores offered by JYMI are informational, self-reported tools. They do not constitute medical advice, a diagnosis, or a medical device in any way, and do not replace the advice of a healthcare professional. Physical training carries inherent risks: you are solely responsible for your own practice and must adjust the intensity of your sessions to your actual physical condition. If you experience pain, unusual discomfort, or any doubt, stop the effort and consult a healthcare professional.

7User obligations

8Intellectual property

The App, its code, design, brand, and all elements that make it up are the exclusive property of the Publisher. No reproduction, extraction, or reuse is permitted without prior written consent, except for the data you create yourself (your sessions, notes, and history), which belongs to you.

9Electronic evidence and recordkeeping

Data recorded in the Publisher's information systems (Firebase / Google Cloud) is kept under reasonable security conditions and constitutes, between the parties, admissible evidence of operations carried out through the App (creating sessions, confirming sets, answering questionnaires), absent manifest error.

10Service availability

JYMI is an app in active development. The Publisher strives to ensure continuous access to the service but does not guarantee uninterrupted availability. Features may be added, changed, or removed at any time, particularly during the testing (beta) phase.

11Liability

The Publisher makes every effort to ensure the accuracy of the information and calculations displayed (statistics, readiness indicators), without guarantee of results. The Publisher cannot be held liable for injuries, damages, or harm resulting from use of the App or from physical activity, nor for interruptions or malfunctions caused by factors beyond its control (the User's connectivity, Store availability, failure of a third-party processor), to the extent permitted by law.

12Termination

You may delete your Account and all of your data at any time from the App's settings. This deletion is permanent and cannot be undone. The Publisher reserves the right to suspend or delete an Account in the event of a clear violation of these Terms.

13Complaints and mediation

Any complaint about the App can be sent tojulien.nivaud@gmail.com. Absent an amicable resolution within a reasonable time, and in accordance with Article L616-1 of the French Consumer Code, any consumer User may use a consumer mediation service free of charge to seek an amicable resolution. Complaints relating to facts more than365 days old at the time they are raised will not be considered.

14Severability

If one or more provisions of these Terms are held invalid, or declared as such by a law, a regulation, or a final decision of a competent court, the remaining provisions will retain their full force and effect.

15Notices

Any notice sent to the Publisher under these Terms must be in writing to the contact address listed at the top of this document. Any notice sent to the User may be sent electronically, in particular via the email address associated with their Account or a notification within the App.

16Governing law

These Terms are governed by French law. Any dispute relating to their interpretation or performance falls under the jurisdiction of the French courts, subject to any mandatory consumer-protection rules applicable in your place of residence.

Terms of Sale

Preamble — current status

As of this version, JYMI does not offer any paid plan: all of the App's features are available for free during the testing phase. These Terms of Sale are published in advance and, as of today, have no practical application. They will only take effect once a premium subscription offer is actually activated, which will be clearly flagged to you within the App before any commitment.

1Purpose

These Terms of Sale are intended to govern, where applicable, the sale of a premium subscription within the JYMI App, between the publisher and any User subscribing to such an offer (the "Subscriber").

2Offers

If and when offered, the premium plan will provide access to additional features beyond the free plan (for example: advanced statistics, extended customization). The precise details of the features included in each offer will be presented within the App before any subscription.

3Pricing and payment terms

Prices, where applicable, will be displayed in euros, all taxes included, within the App, before any purchase is confirmed. Payment will be processed exclusively through the App Store (Apple Inc.) or Google Play Store (Google LLC), depending on the platform used. The publisher does not collect or store any banking data.

4Term and automatic renewal

A premium subscription, if offered on a recurring basis (monthly or annual), will renew automatically at the end of its term, unless canceled by the Subscriber before the renewal date, in accordance with the rules of the distribution platform used.

5Cancellation

The Subscriber may cancel their subscription at any time from their App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; the publisher does not issue prorated refunds for the period already under way, subject to each platform's own policies.

6Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a physical medium whose performance has begun after the consumer's prior express agreement, by which the consumer acknowledges waiving their right of withdrawal. This agreement will be explicitly requested at the time of subscription.

7Legal guarantee of conformity

In accordance with Articles L217-3 et seq. of the French Consumer Code, the Publisher remains bound by the legal guarantee of conformity applicable to the supply of digital content, without prejudice to the warranty against hidden defects under Articles 1641 et seq. of the French Civil Code. If the premium offer subscribed to does not conform to its description, the Subscriber may request that it be brought into conformity, failing which a price reduction or termination of the contract, in accordance with the terms provided by law.

8Refunds

Any refund request is subject to the policy of the platform through which the purchase was made (Apple or Google), as the publisher is not able to process financial transactions directly.

9Consumer mediation

In accordance with Article L616-1 of the French Consumer Code, any consumer Subscriber has the right to use a consumer mediation service free of charge to seek an amicable resolution of a dispute relating to the performance of these Terms of Sale, after a prior written approach to the Publisher has proven unsuccessful.

10Pricing changes

The publisher reserves the right to change the pricing of the premium offer. Any change will be communicated to Subscribers before it takes effect and will not apply to periods already paid for.
